THE IMPORTANCE OF NOTARY EDUCATION

In late 2010, the Illinois Supreme Court ruled in Vancura v. Katris; a decade-long case involving the misconduct of a notary public who thought he was signing documents according to the requirements of his employer and the state.  If there is one lesson Notaries Public across the country can learn from that case is that notaries public are the sole person liable for any inadvertent misconduct.

No longer are notaries public protected under the civil laws in their state if such laws fail to provide basic provisions, such as education, for notaries public.  The message in the Vancura decision resonates across the country: Notaries Public are held to a much higher standard than their civil statutes require.  The notary in the Vancura case likewise discovered  that he was educated according to a weak employer-provided program, facilitated by a non-commissioned trainer, complicated by a weak set of statutory provisions for notary conduct, and this perfect storm led to the notary's personal loss of $30,000 in the court settlement.

The courts shifted the responsibility of education as the ultimate legal responsibility of the notary, regardless of what the state may require.  As the courts ruled that notary education based on a state's weak statutory provisions does little to protect a notary from the "common law" or "best practices" requirements, notary education facilitators should also have proven subject matter qualification and be duly commissioned in their respective states.
